These Terms and Conditions (“Terms”) govern your access to and use of the mobile application (the “App”) provided by 2 Bears Software Limited, a company incorporated and registered in England and Wales under company number 17043222, with its registered office at 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ (“we”, “us”, or “our”).
By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use the App.
1. Purpose and Nature of the App
1.1 The App is provided solely as a general medication reminder and organisational tool.
1.2 The App does not provide medical advice, diagnosis, treatment, monitoring, or clinical decision support, and is not intended to be a medical device under any applicable laws or regulations.
1.3 The App does not verify, validate, or check medication names, dosages, schedules, instructions, interactions, contraindications, or suitability.
1.4 The App must not be used as a substitute for professional medical advice, diagnosis, treatment, or care. Always seek the advice of a qualified healthcare professional regarding any medical condition or medication.
1.5 The App is not intended for emergency use. If you believe you are experiencing a medical emergency, contact emergency services immediately.
1.6 Nothing in the App or these Terms constitutes legal or medical advice. You should seek independent professional advice where appropriate.
2. User Responsibility and Assumption of Risk
You acknowledge and agree that:
2.1 You are solely responsible for:
- managing and taking your medication as prescribed by a healthcare professional;
- independently verifying all medication information; and
- determining whether use of the App is appropriate for your circumstances.
2.2 You are responsible for ensuring that all information entered into the App is accurate, complete, and kept up to date.
2.3 The App may fail to deliver reminders correctly or at all due to factors including, but not limited to:
- software bugs, defects, or updates;
- device settings, notification permissions, power‑saving modes, or operating system restrictions;
- loss of connectivity, network failures, or server downtime;
- low battery, hardware malfunction, or user error.
2.4 You assume all risks associated with using the App, including risks arising from missed, delayed, incorrect, duplicate, or absent reminders.
3. No Warranties
3.1 The App is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory.
3.2 To the maximum extent permitted by applicable law, we disclaim all warranties, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, and non‑infringement.
3.3 We do not warrant that the App will be uninterrupted, error‑free, secure, or compatible with all devices or operating systems.
3.4 We do not guarantee the continued availability of the App or any feature of the App.
4. Limitation of Liability
4.1 To the fullest extent permitted by applicable law, we shall not be liable for any loss, damage, injury, illness, or harm (whether direct, indirect, incidental, consequential, special, or otherwise) arising out of or in connection with:
- reliance on the App for medication management or health‑related decisions;
- missed, delayed, incorrect, duplicate, or failed reminders;
- actions taken or not taken based on notifications generated by the App or the absence of such notifications;
- errors, omissions, inaccuracies, or outdated information entered by users;
- software errors, bugs, interruptions, data loss, or technical failures.
4.2 To the maximum extent permitted by law, we shall not be liable for any:
- loss of profits, revenue, business, or opportunity;
- loss or corruption of data;
- indirect or consequential loss;
- adverse health outcomes or medical complications.
4.3 Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- any liability that cannot be excluded or limited under applicable law.
4.4 International applicability: Where any jurisdiction does not permit the exclusion or limitation of certain warranties or liabilities, such exclusions and limitations shall apply only to the maximum extent permitted by the laws of that jurisdiction.
5. Acceptable Use
5.1 You agree to use the App only for lawful purposes and in accordance with these Terms.
5.2 You must not:
- misuse, disrupt, overload, or interfere with the App;
- attempt to reverse engineer, decompile, or circumvent security features;
- use the App for commercial purposes without our prior written consent;
- use the App in a manner that could harm others or yourself.
6. Data Entry
6.1 All information you enter into the App is provided at your own risk. We do not monitor, verify, or validate any data you enter.
7. Data Storage and Data Loss
7.1 All data you enter into the App is stored locally on your device only. We do not store, back up, or maintain copies of your data on our servers.
7.2 We do not guarantee the retention, recovery, or restoration of any data entered into the App. Loss of access to your device, device failure, uninstalling the App, or Android clearing background or app data may result in permanent and irreversible loss of your data.
7.3 You are responsible for maintaining any backup or export of data you consider important. We shall not be liable for any loss of data arising from circumstances beyond our control or from user action.
8. User Data Accuracy
8.1 We do not monitor, access, review, or verify any information you enter into the App. You are solely responsible for ensuring the accuracy and completeness of all data you enter, including medication names, dosages, schedules, and any other information.
8.2 We accept no responsibility for harm, loss, or adverse outcomes resulting from inaccurate, incomplete, or incorrect data entered by you or any third party using your device.
9. Device Behaviour and Notification Delivery
9.1 We do not guarantee that notifications, reminders, or alerts will be delivered, displayed, or received at any particular time or at all.
9.2 We do not control device‑level behaviour, including:
- battery optimisation and power‑saving modes;
- operating system restrictions on background processes;
- manufacturer‑specific modifications to Android;
- notification suppression or delivery delays; and
- changes introduced by OS or firmware updates.
9.3 You are responsible for configuring your device to permit the App to deliver reminders, including granting notification permissions and disabling battery restrictions for the App where necessary.
10. Payments, Subscriptions, and Monetisation
10.1 The App may currently be offered free of charge; however, we reserve the right to introduce:
- paid features or functionality;
- subscriptions or one‑time purchases; and/or
- advertising or sponsorship.
10.2 Any paid features will be clearly disclosed prior to purchase and may be subject to additional terms.
10.3 Payments and subscriptions processed via the Apple App Store or Google Play Store are governed by their respective terms and policies, which we do not control.
10.4 We do not guarantee that any free features will remain free indefinitely.
11. Intellectual Property
11.1 All intellectual property rights in the App, including software, code, design, text, graphics, and logos, are owned by or licensed to 2 Bears Software Limited.
11.2 You are granted a limited, non‑exclusive, non‑transferable, revocable licence to use the App for personal, non‑commercial purposes only.
11.3 You may not copy, modify, distribute, sell, or exploit any part of the App without our prior written consent.
12. Suspension and Termination
12.1 We may suspend or terminate access to the App at any time, with or without notice, if you breach these Terms or if continued operation of the App is no longer feasible.
12.2 We shall not be liable for any loss or damage resulting from suspension or termination.
12.3 You may stop using the App at any time by uninstalling it from your device.
13. Third‑Party Platforms and Services
13.1 The App is distributed through third‑party platforms, including the Apple App Store and Google Play Store.
13.2 We are not responsible for platform outages, payment processing errors, device compatibility issues, or actions taken by third‑party service providers.
14. Changes to the App or Terms
14.1 We may modify the App, its features, or these Terms at any time.
14.2 Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law and Jurisdiction
15.1 These Terms and any dispute or claim arising out of or in connection with them, the App, or its use shall be governed by and construed in accordance with the laws of England and Wales.
15.2 Subject to any mandatory consumer protection laws applicable in your country of residence that cannot be lawfully excluded or restricted, the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the App.
15.3 Nothing in these Terms limits or restricts your right to bring proceedings in your local courts where such rights cannot be waived or limited under applicable law.
